When is a transit licence required? |
|
"Transit" means a transport of non-Community dual-use items entering and passing through the customs territory of the Community with a destination outside the Community.
The transit licence of dual use items is granted when there are conditions under the article 4, paragraph 1 of the Regulation 428/2009, namely when the items in question are or may be intended, in their entirety or in part, for use in connection with the development, production, handling, operation, maintenance, storage, detection, identification or dissemination of chemical, biological or nuclear weapons or other nuclear explosive devices or the development, production, maintenance or storage of missiles capable of delivering such weapons.
For the issuing of a transit licence the applicant (exporter or importer, or the end-user or a person authorized by one person) submits to the Interministerial Commission the following documents:
1. filled-in Form № 44;
2. completed licence form in five copies - Form № 46;
3. notarized copy of the export licence or copy of a document certifying his right to carry out the activity;
4. copy of the end-user certificate or international import certificate issued by a competent authority of the end-user;
5. copy of a document from the manufacturer of dual-use items, certifying their technical characteristics, functions, qualitative and quantitative composition;
6. document for paid state fee.
According to Art. 49 of the Regulation of implementation of the Defence-Related Products and Dual-Use Items and Technologies Export Control Act the all required documents in a foreign language shall be submitted to the competent authorities by a certified Bulgarian translation.
The transit licence of dual-use items is valid for one year and may be extended once for up to 6 months.
The licence is valid under the conditions and the expiry of the period specified in it, but not more than 30 days from the date of entry into the territory of the Republic of Bulgaria. |
