Council Regulation No. 428/2009 does not apply to:
- dual-use items and technologies just passing through the territory of the European Community, i.e. these for which no customs destination or use is determined, different from the regime of external transit, or these that are just placed in the free zone or a free warehouse;
- supply of services or giving of technologies, where such supply or giving includes cross-border movement of individuals within the Community. |
