Who, how and when issues certificates?
 
Form 52 to art. 43, s. 1, p. 1 – Application for issuance of an end user certificate for dual-use items and technologies, international import certificate for dual-use items and technologies and delivery verification certificate for dual-use items and technologies

In case that the country of the Consignor requires from the Bulgarian Consignee an international import certificate for the dual-use items and technologies, it is issued in two copies in the form of Form 50 from the Ministry of Economy.

To obtain an international import certificate the authorization applicant shall submit to the respective authority the following documents:
1. application for obtaining of a certificate in the form of Form 52;
2. a copy and a certified Bulgarian translation of a document from the foreign consignor or a copy and a certified translation of a contract, certifying the need for issuance of the certificate;
3. a copy and a certified Bulgarian translation of a document, issued by a competent authority in the country of the consignor, certifying his eligibility to perform the import;
In case that according to the national laws of the country the document under p. 3 is not issued, the applicant shall submit to the respective authority a written statement from the Exporter and a certified Bulgarian translation for this effect.


The authorities shall pass their decision on the applications within 15 working days after the date of their receipt and notify the applicant within 3 working days after the date of making their decision.
The international import certificate is presented by the applicant to the foreign consignor.
In case that the certificate is not submitted to the competent authorities in the country of the consignor within 6 months of the date of its issue, the consignee shall return the original of the certificate to the issuing authority.

In case that the country of the consignor requires a delivery verification certificate for the dual-use items and technologies in the formalities of the customs procedure of the items, then the Importer shall submit to the customs authorities at the competent customs institution completed Form 51, as follows:
The applicant obtains a form of Form 51 from the Interministerial Commission after filing of an application for issuance of a delivery verification certificate for dual-use in the form of Form 52.
The Delivery Verification Certificate so presented is certified by the customs authorities at the competent customs institution that have authorized the corresponding customs regime. The first copy of the certificate is given to the Importer, the second copy is sent by the head office of the Customs Agency to the Ministry of Economy within 15 working days, and the third one remains at the head office of the Customs Agency.

In case that the country of the consignor requires from the Bulgarian consignee an end-user certificate for dual-use items and technologies, it is issued in 3 copies in the form of Form 49:
- by the Ministry of Defense – when the items and/or technologies are for the needs of the armed forces;
- by the Ministry of Interior - when the items and/or technologies are for the needs of this ministry;
- by other governmental authorities that use items from the List of Dual-use Items and Technologies, in compliance with the functions that they are intended for.
